The Perishable Agricultural Commodities Act (PACA) is a federal statute that creates special protections for sellers of fresh fruits and vegetables. These sellers are the beneficiaries of a special “trust” in all of the buyer’s perishable commodities, as well as the products made with those commodities and the proceeds from the sale of those commodities.

The PACA trust seller retains title to the perishable commodities until payment is received from the buyer. Until full payment is made, the seller has priority over the rights of the buyer’s secured and unsecured creditors.
