Contractors, subcontractors and materialmen are often confronted with issues involving non-payment and delinquent payment. Your remedies will be governed by your construction contract and Chapter 713 of the Florida Statutes.
Experienced Palm Beach County Construction Law Attorney
Chapter 713 is known as Florida’s Construction Lien Statute. Construction Liens are sometimes referred to as Mechanics Liens. These laws provide the procedures to notify property owners that you are working on their property, file claims of lien in the event that you have not received payment within 90 days of your last services, and to foreclose the claim of lien through a lawsuit in the county where the property is located.
Helping Resolve Construction Contract Disputes
Construction contracts, especially for complex development work, often contain dispute resolution clauses requiring mediation or arbitration.
Property owners also have rights related to construction defects and faulty construction work that is governed by their direct contracts, established case law and chapter 558, Florida Statutes. Chapter 558 is intended to provide a mechanism for resolving construction defect claims prior to suit. The aggrieved property owner is required to notify the contractor of the construction defect issues, and the parties are required to exchange information in an effort avoid a lawsuit.
