Domesticating a foreign judgment in Florida

When a court outside of Florida issues a judgment in your favor, you expect the other party to pay you the amount that the judge has ordered. According to the Florida Statutes, the Florida Enforcement of Foreign Judgments Act does not just refer to foreign countries. It also refers to judgments, orders or decrees issued by a court in another state, in a federal court, or in a territory or commonwealth of the U.S.

You may have the foreign judgment recorded in any circuit court in Florida. The court clerk mails the notice to the debtor, and after 30 days, the foreign judgment operates as a lien. At that time, the judgment falls under the legal and procedural rules that affect any judgment within the county or circuit court where you have it filed. 

The judgment debtor may file an action in the original court that issued the judgment, contesting the jurisdiction of the court that recorded the foreign judgment. Until this is settled, the court will stay the enforcement of the judgment. However, the debtor in another state must show grounds for staying the judgment rather than allowing it to be enforced by the Florida court.
