THE FLORIDA COURT SYSTEM
At the trial level, the Florida state court system is comprised of:
1. Small Claims Division (claims under $5,000)
2. County Court Division (claims between $5,001 and $15,000)
3. Circuit Court Division (claims above $15,000)
Most creditors elect to sue debtors in the Florida state court system, which is efficient and reliable.
Business creditors located outside of the State of Florida also retain the right to sue debtors in Federal Court, as long as the claim amount exceeds $80,000.00. There may be advantages to litigating commercial disputes and collection claims in Federal Court.
In certain circumstances, the contract or agreement between the parties may require an alternative forum for a dispute, such as binding arbitration.
