In certain instances, a business creditor may find it necessary to “freeze” certain debtor assets before a is obtained. This might occur if the judgment creditor believes that the debtor will not have sufficient assets available once the judgment is obtained.
Pre-judgment remedies, such as pre-judgment attachment of the debtor’s personal property or the pre-judgment garnishment of the debtor’s bank account, are governed by Florida Statutes. A proper showing is required in order to convince the Court that this extraordinary remedy is necessary. Typically, a judgment debtor must post an appropriate civil court bond.
