  • Domestication of foreign judgments - this is the process whereby judgments or final determinations from other US states or foreign nations are recorded in Florida. Thereafter, collection efforts can be commenced.
  • Depositions in aid of execution - this is the process whereby sworn testimony is elicited from debtors concerning their assets and finances.
  • Prejudgment remedies - in certain circumstances, a creditor may have the need to quickly and quietly secure the debtor's assets at the commencement of an action or prior to the rendition of a final judgment.
  • Foreclosure of mortgages, liens and UCC security interests - this is the process whereby real property or personal property for which security has been given in exchange for payment of the extension of credit is foreclosed.
  • Garnishments - this is the process whereby a creditor can obtain the debtor's property which is in the hands of the third party. Typically, this method is used to obtain the debtor's funds which are located in a bank or other financial institution.
  • Attachments - this is the process whereby property of the creditor and in possession of the debtor is obtained by the creditor. Typically, a sheriff, marshal or other officer of the law will serve a writ of attachment and the attached property is sold at public sale to satisfy the debt due and owing.
  • Replevins - this is the process whereby the creditor can obtain a return of its own property which has been wrongfully detained by another person.
  • Proceedings Supplementary - this is a process whereby a creditor which holds a valid judgment can pursue its claims against a third party where the creditor believes that the third party holds assets of the debtor.
